Land Status The land where the three major lots are located lies in an area which was designated a Protected Forest in 1973. In 1994, the legislature declared the areas to be disaffected by the earlier law, thereby enabling Finca Tupisa to apply for titles to all properties. Now that the titling process has begun, possession rights may not be legally challenged. The Panamanian government, through a program sponsored by the Bank of International Development (BID), is presently conducting an intensive formal titling program of all farms in the Darien province. The result is a greatly simplified, more efficient titling process, designed to protect the rights of property owners. Titling Procedures The process of titling lots acquired from national lands (Tierras Nacionales) entails, in order: mapping, inspection by the Agrarian Reform Agency, payment for the land, obtaining agreement forms from any relevant neighboring occupants, approval of the maps, inspection and certification by the environmental department (ANAM) officials and, finally, the issuance of deeds and registering of titles by the Agrarian Reform Agency. Plantation Status The five lots of Finca Tupisa, S.A. are presently in various stages of titling. The 71-, 42- and 32-hectare lots are awaiting the certification from ANAM. The deed writing and registration for the 0.5-hectare lot is in process, and the one-hectare lot is fully titled. | |
